Introduction
The Consumer Protection Act, 2019 is a social law in the public interest. It provides for the rights of consumers and provides incentives for the protection of consumer rights. To provide speedy and inexpensive redressal of consumer disputes, a quasi-judicial mechanism has been formed at every district, state and national level. It provides for a three-tier structure of National Commission , State Commission and District Commission for speedy resolution of consumer disputes . Under this Act, the Consumer Disputes Redressal Commission, Gujarat State was constituted in 1989 and subsequently the District Commissions were formed. At present, 38 District Commissions are functioning in the state of Gujarat. Out of these 38 District Commissions, 12 work in close association with the nearest District Commission. District commissions are working in clubbing with Aravalli-Sabarkantha, Botad-Bhavnagar, Chhota Udepur-Vadodara, Dahod-Godhra, Dang-Valsad, Devbhumi Dwarka-Jamnagar, Gir Somnath-Junagarh, Mahisagar-Godhra, Morbi-Rajkot, Narmada-Bharuch, Porbandar-Junagarh, Tapi-Surat. It is specially brought to your attention that at present a total of 30 District Consumer Disputes Redressal Commissions have their own building at their headquarters which is the pride of Gujarat.
District Commission jurisdiction
- Subject to the other provisions of this Act, the District Commission shall have jurisdiction to hear complaints where the amount of consideration paid for goods or services does not exceed five hundred thousand rupees, provided that where the Central Government thinks fit to do so, it may fix such other price as it thinks fit.
- A complaint must be filed with the District Commission within whose local limits the jurisdiction lies.
- The opposing party or each of the opposing parties, where there is more than one, at the time of filing the complaint, is ordinarily resident or carries on business or has a branch or is acting for personal gain, or
- Any of the parties, where there is more than one, at the time of filing the complaint, are actually and voluntarily residing, or carrying on business or having a branch, or acting for personal gain (benefit), provided that in such case the approval of the District Commission has been obtained, or
- The cause of action/complaint has arisen in whole or in part, or
- The complainant resides or is engaged in personal gain.
- The District Commission shall normally function at the District Headquarters and may function at such other places in the District as the State Government may, in consultation with the State Commission, specify in the Official Gazette from time to time.
Power of the State Commission
- Subject to the other provisions of this Act, the State Commission may –
- a)
- Where the value paid in consideration of goods or services exceeds Rs. 50 lakhs but does not exceed Rs. 2 crores, the Central Government may fix such other values as it may deem fit,
- Complaints against unfair contracts, where the value paid in consideration for goods or services does not exceed ten crore rupees,
- To hear appeals against the orders of the District Commissions in the State and
- b) In any consumer dispute pending before or decided by any District Commission within the State, where the State Commission appears to the contrary that such District Commission has exercised powers other than those conferred by law, or has failed to exercise powers conferred upon it, or has exercised its powers illegally or with material irregularity, it shall have the power to call for records and make appropriate orders.
- a)
- The powers, authority and jurisdiction of the State Commission shall be exercised by its Benches, and a Bench shall consist of one or more members as the President may think fit: Provided that the senior most member shall be in charge of the Bench.
- Where the members of the Bench are divided on any point, the points shall be decided by the majority opinion. If there is a majority but the members are equally divided, they shall state the points on which they are divided and refer them to the President who shall hear the point or points himself or refer the case to one or more other members for hearing such point or points and such point or points shall be decided by the majority of the opinions of the members who have heard the case, including those who have previously heard it:
Provided that the President or other members, as the case may be, shall give their opinion on the point or points referred within one month from the date of such reference. - The complaint has to be filed before the State Commission under whose jurisdiction,
- The opposing party or each opposing party, when there is more than one, at the time of filing the complaint, is ordinarily resident or carries on business or has a branch or is acting individually for profit, or
- Any of the parties, where there is more than one, at the time of filing the complaint, are actually and voluntarily residing, or carrying on a business or having a branch or acting individually for profit, in which case the approval of the State Commission has been obtained, or
- The cause of complaint has arisen, in whole or in part, or
- The complainant resides or works for personal gain.
